Whereof James Foster, formerly of Cecil county, died seized for, the purpose of division. The object of this suit is to procure a Decree for the sale of certain Real Estate. The Bill states that James Foster, formerly of Cecil county, was in his lifetime seized and possessed of a tract or parcel of land in Cecil county, containing Two Hundred Acres of land more or less; that being seized he departed this life intestate, leaving John foster, Elisha Foster, Thomas Jefferson Foster, Hannah Foster, Jesse Foster, Nathan Foster, George Foster, Jacob Foster and James Foster, his sons and Sarah Stoops wife of Gustavus Stoops, his daughter, his only heirs at law; that Jesse Foster has since departed this life intestate, leaving a widow Elizabeth Foster, and James W. Foster, John J. Foster and Ann Holt, the complainant of full age and William Thomas Foster, Sarah Catherine Foster, Jesse Foster and Washington Foster, infants under the age of twenty one years his only heirs at law; that Nathan Foster has also departed this life intestate leaving Ann Foster, George Foster, James Foster and Rebecca McCullough wife of Lewis McCullough, his only heirs at law; that George Foster has also departed this life intestate, leaving a widow Maria Foster, Elizabeth Pe arson, wife of Eli Pearson, James Foster, Thomas Foster, Gustavus Foster, Franklin Foster, of full age and Wesley Foster, an infant, under the age of Twenty one years, his only heirs at law; that Jacob Foster, has also departed this life unmarried intestate and without issue, that the said John Foster, Gustavus Stoops and Sarah, his wife, Elisha Foster, Thomas Jefferson Foster, James W. Foster, John J. Foster, William Thomas Foster, Sarah Catherine Foster, Jesse Foster, Washington Foster, Ann Foster, George Foster Lewis McCullough and Rebecca his wife, Eli Pearson and Elizabeth his wife, Maria Foster, James Foster, son of George, Thomas Foster, Gustavus Foster, Franklin Foster , Wesley Foster and James Foster, all reside in Cecil county; and that Herman Foster resides out the State of Maryland in parts unknown to the complainants and that the said James Foster of Nathan, resides in the State of Delaware, that Thomas Jefferson Foster is married and his wife’s name is Rebecca, and that James Foster is also married and his wife’s name is Margery. The bill then charges that the said tract of land is incapable of division and that it is for the interest and advantage of all parties having an interest therein that the same should be sold for the purpose of division but that owing to the infancy of the said William Thomas Foster, Sarah Catherine Foster, Jesse Foster, Washington Foster and Wesley Foster, and the absence from the state of Maryland of Nathan, a sale cannot be had without the interposition of this court. It is thereupon adjudged and ordered, that the complainants by causing a copy of this order to be printed in some newspaper published in Cecil county once a week for one month before the fourteenth day of December next, give notice to the said absent dependants of the object and substance of this bill and warn them to appear in this Court in person or by solicitor, on or before the fifteenth day of March next, to answer the decree and show cause of any they have why a decree ought not to pass as prayed.
