Witnesseth that for and in consideration of the sum of twelve hundred dollars, current money, by the said John W Egner to the said William T Scott and Mary Scott, in hand paid at and before the sealing and delivery of these presents, the Receipt of which they do hereby acknowledge; the said William T Scott and Mary Scott his wife have given, granted, bargained, sold aliened, enfeoffed, Released, conveyed and confirmed and by these presents do give, grant, bargain, sell, alien, enfeoff, Release, convey and confirm, unto the said John W Egner his heirs and assigns all that Farm or Tract or part of a Tract of land lying in Cecil County and State of Maryland and in New Castle County in the State of Delaware, Known as the Whiteley or McIntyre Farm, and bounded as follows to wit. On the North by the Road leading from New Ark to Fair Hill, on the South by lands of James Murray, on the East by lands of Thomas Stelle and others and on the West by the Road leading from New Ark to Turkey Town and containing forty four acres of land more or less, being the same property which was conveyed to the said William T Scott by a certain Henry Whitely of New Castle County in the State of Delaware by Deed duly executed acknowledged and Recorded among the Land Records of said County of New Castle and in Liber JS No 41 folio 340 etc one of the Land Record books of Cecil County aforesaid, Except so much thereof as is conveyed by the said William T Scott and Mary Scott his wife, to a certain James Fulton, by Deed duly Executed acknowledged and Recorded among the Land Records of New Castle County aforesaid and in Liber GMC No 3 folio 316 etc another of the Land Record books of the said County of Cecil together with all and Singular the buildings improvements, woods, ways, waters, water courses, Rights, members. privileges, advantages and appurtenances thereunto belonging, or in any wise appertaining, and all the Estate, Right, title and interest, trust property and demand whatsoever at law and in Equity of them the said William T Scott and Mary Scott his wife of in and to the same. To Have and To Hold the said herein described premises, with the appurtenances thereunto belonging, unto the said John W Egner his heirs and assigns, to the only proper use of the said John W Egner his heirs and assigns forever. In Testimony Whereof the said William T Scott and Mary Scott his wife have hereunto Respectively set their hands and affixed their seals, on the day and year first herein before written. Wm T Scott Mary Scott Witness Mary A Greagg, W McCaulley State of Delaware, New Castle County, Sct Be it Remembered and it is hereby Certified that on this Twenty seventh day of October, in the year of our Lord one thousand Eight hundred and forty seven, before me the subscriber Commissioner duly appointed to take acknowledgements in the State of Delaware of Deeds passing Real Estate in Maryland, personally appear William T Scott and Mary Scott his wife they being satisfactorily proven by oral Testimony, under oath, Received by me to be the persons who are named and described as and professing to be the parties grantors to the foregoing deed or indenture, and do severally acknowledge the said indenture or instrument of Writing to be their Respective act and deed, the said Mary Scott having signed and sealed said Indenture before me, out of the presence and hearing of her husband, and the said Mary Scott being by me examined, out of the presence and hearing of her said husband “Whether she doth Execute and acknowledge the same freely and voluntarily, and without being induced to do so by fear or threats of or ill usage by her said husband or by fear of his displeasure” declareth and saith that she doth.
