All rights reserved. http://www.usgwarchives.net/copyright.htm http://www.usgwarchives.net/md/mdfiles.htm ************************************************ File contributed for use in USGenWeb Archives by: Mark Ault meault@yahoo.com February 9, 2009, 1:43 pm Addition to the Wolf Pit and Hove's Patience Written: April 3, 1802 Recorded: April 3, 1802 Frederick County Land Records – WR 22 437 At the request of Jacob Hoff the following deed was recorded the 3rd April 1802: This indenture made the third day of April in the year of our Lord eighteen hundred and two between Daniel Kemp of Frederick County and State of Maryland of the one part and Jacob Hoff of the County and State aforesaid of the other part witnesseth that the said Daniel Kemp for and in consideration of the sum of fifty pounds current money to him in had paid by the said Jacob Hoff before the sealing and delivering of these presents the receipt whereof is hereby acknowledged hath given granted bargained and sold aliened released enf??? And confirmed and by these presents doth give grant bargain and sell alien release enfer? And confirm unto him the said Jacob Hoff his heirs and assigns forever all that piece part or parcel of land lying and being in the county and state aforesaid being part of a tract of land called the addition to the Wolf Pit Beginning for the part hereby intended to be conveyed at a stake on the southeast bank of the mill race where the third line of said Addition to the Wolf Pit crosses the said race it being at or near the end of thirty six perches on said line and running thence with said land reversed the two following courses to wit south eighty two degrees east thirty six perches to the end of the second line of said land north nineteen and an quarter perches then north seventy one degrees and an half degrees west three perches to the bank of the aforesaid mill race then down with the bank of said race to the beginning containing four acres and an quarter of an acre of land more or less. Also all that part of a tract of land called Hove’s Patience which was conveyed by Jacob Hoff to Christian Kemp for a ??? race by deed bearing date the twelfth day of July seventeen hundred and fifty beginning for said part at the end of eighteen and a third on the seventh line of Hove’s Patience and running thence north twenty seven degrees and an half degree west twelve and an half perches north twelve degrees and an half degree west twelve and an half perches north twelve degrees east fifteen perches north seventeen degrees and an half degree east fourteen perches north seventy two and an half degree west two perches south twenty five degrees west fourteen perches south seventy two and an half degrees east two perches south twelve degrees west fifteen perches south twenty seven and an half degrees east twelve and an half perches then to the beginning containing by estimation ninety six perches of land more or less. Together with the appurtenances whatsoever to the said parcels of land belonging or in any wise appertaining and are the estate right title property interest claim and demand whatsoever of him the said Daniel Kemp of in and to the written described lands and premises. The said Daniel Kemp further grants unto him the said Jacob Hoff the benefit of what water will discharge through an inch auger hole, through a pipe, to be taken at half the height of the full load of water in the ????, also one half of the waste water. To have and to hold the said land and premises with the appurtenances and privileges unto him the said Jacob Hoff his heirs and assigns to the only proper use and behoof of him the said Jacob Hoff his heirs and assigns forever. And the said Daniel Kemp for himself and his heirs the said parcels of land and premises within mentioned with the appurtenances unto him the said Jacob Hoff his heirs and assigns shall and will warrant and forever defend by their presents against them the said Daniel Kemp his heirs executors and administrators and against all and every other person or persons claiming by from or under him. In witness whereof he the said Daniel Kemp hat hereunto set his hand and affixed his seal the day and year first written Signed sealed and delivered in the presence Daniel Kemp {seal} of John Schley Henry Kemp Which was thus endorsed to wit: Frederick County sct on the day and year first within written came the within name Daniel Kemp before us the subscribers tow of the Justices of the Peace for the county aforesaid and acknowledged the within instrument of writing to be his act and deed and the parcels of land and premises within described to be the right and estate of the within named Jacob Hoff his heirs and assigns forever according to the true intent and meaning of the within deed and the act of assembly in such case made and provided. At the same time also appeared before us Catherine wife of the said Daniel Kemp who being by us examined privately from and our of the hearing of her said husband “whether she doth her acknowledgement of the same freely and willingly and without being induced thereto by fear of threats of or ill usage by her said husband of through fear of his displeasure” declared that she doth freely and willingly and with being induced thereto by fear of threats of or ill usage by her husband or through fear of his displeasure acknowledge as aforesaid.
