He was engaged in marking cars, and was standing on the track, when a train came along and struck him, the wheels of one car passing over him, severing his right leg. The body was taken to Devore's on Grant street, where an inquest will be held to-day. Deceased was about thirty years of age, and resided on Penn avenue, near Twenty-second street. from The Pittsburgh Commercial Gazette dated Monday, August 19, 1878 (page 4): The Coroner's jury in the case of James (sic) McILWAINE rendered a verdict as follows: James McILWAINE came to his death on the night of August 15, A D 1878, in the Thirteenth ward, Pittsburgh, by being run over by detached freight cars on the Pennsylvania Railroad. We, the jury, believe the railroad company is guilty of gross negligence by not having a man on the front of their train to protect the lives of employees working on the track; also for not furnishing sufficient hands to drop cars from Lawrenceville station to Twenty-eighth street and Transfer station, there being only one man to handle seven or eight cars. from the City of Pittsburgh Death Records: Joseph McILWAINE, age 28 years, single, railroad man, died August 16, 1878, killed on railroad; born in Ireland; lived at 822 Penn Avenue; burial in Allegheny Cemetery on August 19, 1878. The Allegheny Cemetery site notes the burial of Joseph McILWAIN in Section 33, Lot 97.
