Will Filed June 18, 1879. In the Name of God, Amen. I, James Barr, of Pittsburgh County of Allegheny and State of Pennsylvania being of sound mind and memory, do hereby make, publish and declare this to be my Last Will and Testament, in manner and form following; hereby revoking any will or wills heretofore made by me. First, I direct all my just debts and funeral expenses to be fully paid and satisfied, as soon as conveniently may be after my decease. Second. I give devise, and bequeath to my Beloved wife Susan Barr the house and lot, in which we now live, situate on Ellsworth Ave in the 20th ward of city aforesaid and by me owned to have and to hold the said house and lot for and during her natural life. and at the death of my said wife all the property hereby devised to her as aforesaid I give and devise unto my nine children viz. Seven Sons, William S., James, Oliver, Frederick, John N., Harvey, & Murray, and my two daughters, viz. Margaret S. and Elizabeth S. share and share alike, their heirs and assigns forever. Provided, that before my said nine children shall receive their respective shares, that my Grandson James Barr Jr. son of my son James and also James Barr Jr. the son of my son Frederick shall each receive the sum of one Hundred Dollars their heirs or assigns. Provided further that should my son Oliver on his return home, have not amended his ways or reformed his life, that he shall not receive any share or Benefit whatsoever from my estate, and his share in said estate shall be divided equally among my other eight children, share and share alike and in lieu therof my son Oliver shall receive the sum of one Dollar. Third. I give devise and bequeath unto my sons William S. and James, Two acres and 2 perches of land, owned by me and situate in Versailles Township and partly in Patton township in the County and State a aforesaid on the Death of Marshall Brinton, to be theirs, their Heirs and Assigns Forever. And Further I devise especially that should any of my aforesaid sons by reason of rudeness or mis-conduct offend or cause sorrow to their Mother, that my Executors Hereafter mentioned shall pay to each and every of my sons so offending – the sum of One Dollar which shall be in lieu thereof and in full – of any share or Benefit in my Estate and their shares heretofore alloted them shall be divided among my other children, share and share alike. And I further Desire that my Executors, Hereinafter named shall use their utmost endeavors to recover from the City of Pittsburgh value for the Damages sustained by me by the street improvements of said City (viz. Ellsworth Ave) by which my said House and Lot was greatly damaged and for which I have received no benefit or consideration whatever, and whatever sum of money my Executors may recover from said City, I desire that it may be applied to my just debts and any sum of money remaining to be divided among my children share and share alike, But subject to the same restrictions and directions as Before mentioned and Expressed. And I do Hereby constitute and appoint my two sons, William S. Barr and John M. Barr to be the Executors of this my Last Will and Testament. In witness whereof, I James Barr, the Testator have to this my Will set my hand abd Seal, this Twenty Second Day of February, A.D.
