I Benjamin Phillips considering the uncertainty of this mortal life and being of sound mind and memory (Blessed be Almighty God for the same) do make and publish this my last Will and Tstament in manner and form following (viz) first my will is that all my just debts and funeral expenses at my decease be first paid, secondly, To my beloved Wife Sarah Phillips I will and bequath the plantation on which I now live together with one house Creature and one Cow, and fifty dollars worth of Household furniture which she is to hold while she remains my widow. Thirdly, to my daughter Rachel Gibson, Elizabeth Runker, Hannah Hill, and Sarah West I will and bequeath to each one the sum of Two dollars together with what I have already given them, fourthly, to my daughter Mary Ann Mitchell I will & bequeath the sum of one hundred Dollars in moveable property and to have a home where I now live so long as she remains single, fifthly, to my sons Elijah and Daniel Phillips I will and bequeath the sum of three hundred Dollars each, Sixthly, To my sons David and Benjamin Phillips I will and bequeath the plantation on which I now live to come to their use and in their possession at the Decease or marriage of my Widow. Also I will I will and bequeath to my sons David and Benjamin the plantation belong to me in Redstone Township of about forty Acres, adjoining lands of Samuel Crable, Peter Colley, Elijah Phillips and others, (Seventhly), To my Granddaughters Say (?) Ann Mitchell I will and bequeath the sum of twenty Dollars in furniture or moveable property. (Eighthly), the balance of my personal estate I will and bequeath to my two sons David and Benjamin and my will is that my two sons David and Benjamin pay all the above mentioned legacies to my other sons and Daughters all of which are to be paid in twelve months after my decease. And I do by these presents constitute and appoint my beloved Wife Sarah Phillips and my two sons David and Benjamin Phillips to be Executors of this my last will and testament and I do by these presents hereby revoke all former Wills by me made and publish this to be my last Will and Testament. In Witness whereof I have hereunto set my hand and seal the Eighth day of May in the year of our Lord one thousand and eight hundred and thirty two. Benjamin Phillips (seal) Signed Sealed and published in the presence of us the undersigned Witnesses John Ball Thomas Grier Jun Fayette County SS On the 23rd day of August, Anno Domini 1835 personally appeared before me John Keffer/Kesffer Register for the probate of Wills and granting letters of administration in and for the County of Fayette aforesaid, John Ball, the first subscribing witness to the foregoing Instrument of writing purporting to be the Last will & Testament of Benjamin Phillips late of Menallen Township, Fayette County, deceased and on his solemn oath (by uplifted hand) declared that he saw the Testator execute the same as and for his last will and Testament when of sound mind knew of no undue influence used or late will made by said deceased to his knowledge of belief and that he subscribed the same as a Witness in the presence of the Testator. And on the same day personally came Joseph Jefferies and on his oath declares that he is well acquainted with the handwriting of Thomas Grief Jun the last subscribing witness to the foregoing will, having frequently seen him write and verily believes the signature Thomas Grief Jun set as a witness to said will to be his proper handwriting and genuine signature. In testimony whereof I have hereunto set my hand and seal of the Registers office at Union Town the 22nd day of August Anno Domini 1835.
