All rights reserved. http://www.usgwarchives.net/copyright.htm http://www.usgwarchives.net/pa/lancaster/ _______________________________________________ Lancaster County, Pennsylvania Deed Book U38, page 293-295 West Cocalico Township Written: March 29, 1884 Recorded: April 14, 1947 13951 Samuel Mellinger et ux to Samuel Dornbach } THIS INDENTURE, Made the twenty ninth day of March in the year of our Lord one thousand eight hundred and eighty four (1884) BETWEEN SAMUEL MELLINGER of the Township of West Cocalico, in the County of Lancaster and State of Pennsylvania and ELIZA his wife of the one part and SAMUEL DORNBACH of the same place aforesaid of the other part, WITNESSETH, That the said Samuel Mellinger and Eliza his wife for and in consideration of the sum of Three hundred and thirty two dollars and six and one quarter cents lawful money of the United States of America, unto them well and truly paid by the said Samuel Dornbach at and before the sealing and delivery of these presents, the receipt whereof is hereby acknowledged, have granted, bargained, sold, aliened, enfeoffed, released and confirmed, and by these presents do grant, bargain, sell, alien, enfeoff, release and confirm unto the said Samuel Dornbach his heirs and assigns, ALL THAT CERTAIN piece of land situate in West Cocalico Township Lancaster County aforesaid, being bounded and described as follows, to wit: BEGINNING at a stone in a certain lane thence along said road or lane by land of Abraham Dinger north ten and a half degrees west, nineteen perches and fifteen one hundredth to a post; thence by land of Jacob Kurtz the following eight courses and distances to wit, south eighty seven and a half degrees east, four perches and three tenths to a post; north twenty four degrees east twelve and four tenths perches to a post; north six and three quarter degrees west eight perches to a psot; north ten and a half degrees east, eighteen and six tenths perches to a post; north thirty nine and three quarter degrees east, three perches and fifteen one hundredth to a post; north forty eight and a quarter degrees east, eight perches and eight tenths to a post; north sixty one and a half degrees four perches and fifty five one hundredths to a post; and north seventy seven and one quarter degrees east two perches and five one hundredth to a post; thence by land of Isaac Dornbach south five degrees east forty three perches and two tenths to a sone; thence by land of Frederick Bennetch south sixty nine and three quarter degrees west, thirteen and six tenths perches to a stone; thence by land of the same south thirty five degrees west twenty three perches and eight tenths to the place of Beginning. Containing six acres and six perches neat measure. IT BEING a part of the same premises which by sundery good conveyances and assurances in law duly had and executed became vested unto Jno. Kurtz and to his heirs and assigns forever, and the said Jno. Kurtz by his indenture dated the first day of March A.D. 1859 for the consideration therein named did grant and confirmed the same unto Jacob Kurtz and to his heirs and assigns forever and the said Jacob Kurtz and Lydia his wife by their indenture bearing date the 28th day of March A.D. 1864 for the consideration therein named did grant and confirm the same unto Peter Dinger and to his heirs and assigns forever, And the said Peter Dinger being so thereof lawfully seized died intestate leaving to survive him five children to wit, Abraham Dinger, Peter Dinger, Sarah now the wife of Amos White Martha Dinger and Elizabeth now the wife of Michael R. Shenk to whom the same did descend and come under the intestate laws of the state of Pennsylvani, and the said Peter Dinger, Amos White and Sarah his wife Martha Dinger Michael R. Shenk and Elizabeth his wife by Abraham Dinger their attorney in fact specially constituted by Power of Attorney bearing date the 22nd day of July A.D. 1876 and recorded in the office of Recording deeds &c. in and for the county of Lancaster in Letter Book No. 7 page 528 as by reference thereunto had appears and the said Abraham Dinger and Elizabeth in right of themselves did by indenture bearing date the second day of March A.D. 1877 for the consideration therein mentioned did grant and confirm the same unto Samuel Mellinger (party hereto) and to his heirs and assigns forever recourse being had, appears. TOGETHER with all and singular the improvements says, waters, water-courses, rights, liberties, privileges, hereditaments and appurtenances whatsoever thereunto belonging, or in any wise appertaining, and the reversions and remainders, rents, issues and profits thereof; and all the estate, right, title, interest, property, claim and demand whatsoever of them the said Samuel Mellinger and Eliza his wife in law, equity, or otherwise howsoever, of, in and to the same and every part thereof, To have and to hold the said piece of six acres and six perches land neat measure hereditaments and premises hereby granted or mentioned and intended so to be, with the appurtenances unto the said Samuel Dornbach his heirs and assigns, to and for the only proper use and behoof of the said Samuel Dornbach his heirs and assigns for ever. Under the subject to a road twelve feet wide between this tract and the land of Abraham Dinger Also subject to a lane for the use of Isaac Dornbach between Frederick Bennetech’s land and the within described tract. And the said Samuel Mellinger and Eliza his wife for themselves their heirs, executors and administrators, do by these presents, covenant, grant and agree, to and with the said Samuel Dornbach his heirs and assigns, that they the said Samuel Mellinger and Eliza his wife their heirs, all and singular the hereditaments and premises herein above descirbed and granted, or mentioned and intended so to be, with the appurtenances, unto the said Samuel Dornbach his heirs and assigns, against them the said Samuel Mellinger and Eliza his wife their heirs, and against all and every other person or persons whomsoever lawfully claiming or to claim the same or any part thereof, shall and will excepting as above excepted warrant and forever defend. In witness whereof, the said parties to these presents have hereunto interchangeably set their hands and seals. Dated the day and year first above written. Stewart LEBANON COUNTY SS: On the 29th day fo March Anno Domini 1884 before me, the subscriber a Notary Public in and for the said county personally appeared the above named Samuel Mellinger and Eliza his wife and in due form of law acknowledged the within indenture to be their and each of their act and deed, and desired the same might be recorded as such; and the said Eliza being of full age, and separate and apart from her said husband by me thereon privately examined, and the full contents of the within deed being by me first made known unto her did thereupon declare and say that she did voluntarily and of her own free will and accord, sign, seal, and as her act and deed, deliver the within written indenture, deed or conveyance, without any coercion or compulsion of her said husband.
