Warg In the name of God Amen. I Charles F. Warg of the township of Palmyra in the county of Wayne and State of Pennsylvania Shoemaker being weak in body but of sound mind memory and understanding do make my last will and testament in manner and form following. I direct all my just debts and funeral expenses to be fully paid and satisfied by my executor hereinafter named as soon as conveniently may be after my decease. I give and bequeath to my beloved Jane Wilhelmina Warg all my household furniture and personal property (excepting the stock and tools in the Shoe Shop) also all book accounts and sum or sums of money that may be due and owing to me at the time of my decease. I give and bequeath unto my son Rinhard R. Warg all my real estate situated in said Palmyra township on the following conditions. Vis. The said Rinhard R. shall pay or cause to be paid unto my wife Jane W. during her lifetime or so long as she shall remain my widow the full interest of six per cent on the sum of eleven hundred dollars such interest to be paid in quarterly installments of sixteen dollars and fifty cents each in every three months during the period above named and if necessary for the support of my said wife Jane W. he shall from time to time when needed in addition of the said sum of sixty six dollars per annum pay or cause to be paid to her such sums of money requisite for comfortable maintenance as shall in amount total not exceed the sum of Eleven hundred dollars and if after the decease of my said wife Jane W. there shall remain any residue of the said eleven hundred dollars the said Rinihard R. shall pay or cause to be paid unto my daughter Amelia R. or to her children one fourth part of said residue within one year after my said wifes decease also unto my second daughter Louisa R. one fourth part of such residue within three years after my said wifeís decease also to my third daughter Augusta P. a like one fourth part of such residue with four years after the decease of my said wife and the balance viz. the one fourth part of such residue shall be and remain to my said son Rinihard R. and his heirs forever. And in case the said Rinihard R. should die before the decease of my said wife she shall have the free and uninterrupted use of the South wing (kitchen) of the furniture (?) and sufficient land appurtenant for its full use and enjoyment during her lifetime. ___ ___ ___ that in case my said wife Jane W. should again intermarry my said son Rinihard R. shall in lieu of the above pay to my said wife in one year after her said marriage one third of the residue of the said eleven hundred dollars and the balance viz. two thirds of said residue shall be divided into four equal parts one part to be paid to the said Amelia R. in two years after said marriage one part to said Louisa R. in four years after said marriage one part to said Augusta P. in five years after said marriage and the other part shall remain in the said Rinhard R. forever and in case any of my said children should die before said payments should become due the several payments shall be paid to the respective heirs of the body of such deceased child or children. Also it is my desire that my youngest daughter Augusta P. shall have a home with her mother as long she shall remain single or unmarried. I give and bequeath unto my said son Rinihard R. my tools and furniture belonging to the business of shoe and boot making now in the shoe shop. Also leather to the amount of fifty dollars. All the balance and residue of my property whether personal real or mixed I give and bequeath to my beloved wife Jane W. Warg. And I do hereby constitute and appoint my said wife Jane W. Warg executry (sp) and my son Rinihard R. Warg executor of this my last will and testament. In witness whereof I Charles F. Warg the Testator have to this my will written on one sheet of paper set my hand and seal this twelfth day of August A.D. One thousand eight hundred and sixty five. (Signed) Charles F. Warg as and for his last will and testament in the presence of us who have here unto subscribed our names at his request as witnesses hereto in the presence of the said rest alone and of each other, Richard Teeter, Daniel Kauseman, Freelouh V___ns Wayne County S.S. This day before me Me Regau Register for the Probate of Wills and granting letters of Administration personally came Richard Teeter and Daniel Kunzman the subscribing witnesses to the above Will who being duly sworn according to law do say that they were present and saw and heard Charles F. the Testator sign seal publish pronounce and declare the foregoing Instrument of writing as and for his last Will and Testament and that at the time of so doing he was of sound mind memory and understanding to the best of their knowledge and belief. Witness my ___ and official seal at the Registers office in Honesdale this 9th day of July 1866. M Regau Now to wit July 9th 1866 Letters testamentary have been granted to Jane Wilhelmina Warg and Rinihard R. Warg. They have complied with the requirements of the law.
