Petition of Henry Tanner, one of the sons of Michael Tanner, late of the county of York... Yeoman, deceased who died intestate, was read to the court setting forth that the petitioner's father lately died intestate leaving a widow named Anna and lawful issue and representatives of such issue to survive him namely: Jacob his eldest son of Frederick County, Maryland Catharine intermarried with George Wearly, now deceased, leaving lawful issue to survive her. Anna intermarried with Steven Peterin Michael now deceased leaving lawful issue to survive him, that is, Anna intermarried with David Beckner Maudlina of full age and unmarried Barbara Samuel Jonathan Elizabeth Michael minors under the guardianship of Henry Tanner and Henry Hoff Elizabeth intermarried with Christian Bear Philip Henry Mary intermarried with Henry Hoff. [decedent was] owner of a house and lot of ground with the appurtenances situate in the town of Hanover in the said county situate on the north side of York Street and adjoining lots of Jacob Eiker and Francis Himes and known on the general plan of the said town by the #___. That the said widow and the children of the said intestate and the representatives of the deceased children of the said intestate hold the same as tenants in common and undivided That therefor the petitioner prays that an inquest may be appointed by the court to make partition of the said premises to and amongst the aforesaid tenants if such partition can be thereof made without prejudice to and spoiling the whole, but if such partition cannot be made without prejudice to or spoiling the whole then to value the whole undivided and make report of their procedings to the Orphan's Court that such further proceedings may be thereupon had as the act of assembly in such cases provided directs and enjoins Wherefor it is considered and ordered by the Court that the Sheriff in his proper person with twelve good and lawful men of his bailiwick in the presence of all the parties who shall choose to attend and the guardians of such of them as are minors they respectively having due and previous notice therof to hold an inquest of the said messuage and lot of ground and make partition thereof with the appurtenances to and among the said widow and children and representatives of the said deceased children of the intestate if the same will admit of such partition without prejudice to or spoiling the whole but if the same will not admit of such partition without prejudice to or spoiling the whole then to value the whole undivided agreeable to the directions of the Acts of the General Assembly of the State of Pennsylvania in such case made and provided and that the said Sheriff do make return of the said inquest as well under the hand and seal of the said Sheriff as also under the hands and seals of the said jurors upon their respective oaths or affirmations to the next Orphan's Court after the said inquisition shall be held p. 41. Henry Miller Esq. High Sheriff of York County came into court and made return of an order of a former Orphan's Court whereby he was commanded to make partition of a messuage and lot of ground situate in the town of Hanover and the county of York aforesaid and on the north side of York Street and adjoining lots of Jacob Eiker and Francis Himes and known on the general plan of the said town by the number of ___ the appurtenances.... late the estate of Michael Danner the elder deceased who died intestate to and among the widow and children and heirs or representatives of the said intestate if the same would admit of such partition... It appears that the same will not admit of such partition in manner aforesaid without prejudice to or spoiling the whole and that the said messuage or lot of ground with the appurtenances is of the value of £180 lawful money of Pennsylvania in specie gold or silver undivided and which valuation the Court do hereby confirm. And now came into court Jacob Danner eldest son and heir at law of the said intestate and prayed to be permitted to take the said messuage and lot of ground and premises with the appurtenances late belonging to his late father deceased at the said valuation he paying unto the widow and other children and representatives of the said intestate their respective shares thereof whereupon it is ordered and decreed by the court that the said Jacob Danner be allowed the sum of £8-17 shillings the expences and costs of these proceedings that he pay unto Anna the widow of the said intestate yearly and every year during the term of her natural life of the said Anna the sum of£3-6 shillings and 5 pence half penny lawful money aforesaid in full for the right or claim of dower of the said Anna out of the said messuage or lot of ground and premises The first payment whereof to be made in one year from this day. That he retain in his hands he sum of £25 7 shillings and 1 penny and after the death of the said Anna the widow of the said intestate the farther sum of £12-13 shillings and 6 pence half penny in full for his two shares of the said valuation as eldest son and heir-at-law of the said intestate. That he pay unto the heirs of the body of Catharine now deceased and who had been intermarried with George Wearly in equal portions in right of the said Catharine within one year from this day the sum of £12-13 shillings and 6 pence half penny of like money and after the death of the said widow the farther sum of £6-6 shillings and 9 pence farthing of like money in full for the share of the said heirs in right of the said Catharine deceased as one of the daughters of the said intestate. That he pay unto Stephen Peter and Anna his wife in right of the said Anna also within one year from this day the like sum of £12-13 shillings and 6 pence half penny of like money and after the death of the said widow the farther sum of £6-6 shillings 9 pence farthing of like money in full for the share of the said Peter Stephen and Anna his wife in right of the said Anna as one of the daughters of the said intestate. That he also pay unto the heirs of Michael Danner the younger also deceased in such portions as the law directs within one year from this day the like sum of £12-13 shillings 6 pence half penny of like money aforesaid and after the death of the said widow the further sum of £6-6 shillings 9 pence farthing of like money in full for the share of the said heirs of the said valuation in right of the said Michael Danner the younger deceased as one of the sons of the said intestate. That he pay unto Christian Bear and Elizabeth his wife in right of the said Elizabeth within one year from this day the like sum of £12 13 shillings 6 pence half penny of like money and after the death of the said widow the farther sum of £6 6 shillings 9 pence farthing of like money in full for the share of the said Christian Bear and Elizabeth his wife of the said valuation in right of the said Elizabeth as one of the daughters of the said intestate That he pay unto Philip Danner in his own right also within one year from this day the like sum of£12 13 shillings 6 pence half penny of like money aforesaid and after the death of the said widow the farther sum of £6 6 shillings 9 pence farthing of like money in full for the share of the said Philip of the said valuation as one of the sons of the said intestate. Unto Henry Danner in his own right also within one year from this day the like sum of £12 13 shillings 6 pence half penny of like money aforesaid and after the death of the said widow the farther sum of £6 6 shillings 9 pence farthing of like money in full for the share of the said Henry of the said valuation as one of the sons of the said intestate. And that he also pay unto Henry Hoff and Mary his wife in right of the said Mary within one year from this day the like sum of £12 13 shillings 6 pence and half penny of like lawful money aforesaid and after the death of the said widow the farther sum of £6 6 shillings 9 pence farthing of like money in full for the share of the said Henry Hoff and Mary his wife in the right of the said Mary of the said valuation as one of the daughters of the said intestate which said several sums including the cost aforesaid are in full of the amount of the said evaluation. And it is further ordered and decreed by the Court that upon the said Jacob Danner making the several payments aforesaid or giving good security for the same at the days and times before mentioned and expressed that thereupon the said Jacob Danner his heirs and assigns do hold the said messuage and lot of ground of which his said late father died seized with the hereditaments and appurtenances for the same estate and in as full and ample a manner to all intents and purposes as the said Michael Danner the elder deceased in his lifetime held and enjoyed the same and that exonerated and discharged of and from the further claims of the said widow and children and representatives of the said intestate and all persons claiming the same or to claim by from or under them or any of them... Additional Comments: In this petition, the children of Michael Tanner are named, as well as the children of Michael Tanner, the younger, who predeceased his father.
